----beginning of NewEarth Certificate License---- NEWEARTH CERTIFICATE LICENCE 20 January 2002 BACKGROUND By using the web pages and software provided by the NewEarth Swedenborg BBS (hereinafter referred to as "the Service") it is possible to create entries in a directory database known as "the NewEarth Directory." Items that may be generated include X.509 Certificates which may be stored in the Directory or downloaded to your computer for other uses. Each Certificate consists of two parts, a Public Key and a Private Key. COPYRIGHT HOLDER The NewEarth Directory, the NewEarth Certificate Authority and all Certificates generated thereby, whether using the X.509 standard, the PGP standard, or any other Public Key Encryption standard, are the copyrighted work and property of Michael V. David, hereinafter referred to as the "Copyright Holder." This present general public License is granted by the Copyright Holder, and may be altered or revoked, without notice, at any time. Your individual License, derived from this present general public License, may also be altered or revoked by the Copyright Holder at any time, without notice and without regard to any license granted to any other person. NEWEARTH USER AGREEMENT This License incorporates by reference the NewEarth User Agreement, found at http://newearth.org/info/legal/user.php. By accepting or exercising any rights granted under this present License, or by possessing, copying, storing or using any item to which this License applies, you subscribe to the NewEarth User Agreement, and agree to be legally bound by that Agreement. LIMITATION OF LIABILITY No warranties of any kind are expressed or implied by any Certificate issued by the Service. While Public Key Encryption may be used, in conjunction with other practices, to create or enhance the security of communications and of data stored on computers, it does not and cannot in itself guarantee such security. By accepting or exercising any rights granted under this present License, or by possessing or using any Certificate issued by the Service, you assume complete responsibility for any damage you may suffer in the course of your use of any such Certificate, even if such damage is caused by the negligence, malice or criminal conduct of another party, and you release and hold harmless the Copyright Holder, the users of the Service, and the owners of the Property on which the Service is located, for any such damage you may suffer. LICENSE TO USE PUBLIC KEYS You are licensed to download, copy and use the Public Key of any Certificate contained in the Directory. LICENSE TO USE PRIVATE KEYS You are licensed to download, copy and use the Private Key of any Certificate which was created at your request by the NewEarth Certificate Authority, or which is contained in a NewEarth Directory entry owned by your NewEarth Directory User Account. PROHIBITED USES You are specifically prohibited from using any Certificate, Directory Entry or authentication token created by means of the Service for the purpose of obtaining unauthorized access to data, circumventing any access control system, or for participating in any activity that would be illegal in the Territory where the Service is located, or that disobeys the lawful orders of the owners of the Property where the Service is located. /signed/ Michael V.
